Bill Cosby’s lawyer file fresh appeal for another trial
The lawyers of American comic actor, Bill Cosby have officially filed an appeal of his sex assault conviction, claiming the trial judge himself is guilty of 11 legal flubs that should win him a new trial.
The list of “errors” includes the fact that Montgomery County Court Judge Steven O’Neill allowed additional accusers to take the stand against the sexual predator.
Bill Cosby’s lawyers wrote:
“The trial court abused its discretion, erred and infringed on Mr. Cosby’s constitutional rights to Due Process of Law under the Constitution of the United States and of the Commonwealth of Pennsylvania in admitting five prior ‘bad act witnesses,”
The defense claims the allegations were “too remote in time” and “too dissimilar to the Constand allegations”.
Bill Cosby is serving three to ten years in prison for the drugging and molestation of one-time friend Andrea Constand. In addition to Constand, Heidi Thomas, Janice Baker-Kinney, Chelan Lasha, Maud Lise Lotte Lublin and supermodel Janice Dickinson also testified that they had been drugged and sexually assaulted by the actor.
Prosecutors have 30 days to respond to the filing, after which the Superior Court will determine if it will examine the case.
